Article 1: General
WebFoundry (hereinafter "WebFoundry") considers the protection of personal data essential and wants to give its customers and website visitors maximum control over their personal data. This privacy policy describes which personal data WebFoundry collects, why it is collected, how long it is stored, how it is secured and which rights you have as a data subject.
By using the website or services of WebFoundry, you acknowledge having read this privacy policy.
Article 2: Scope
This privacy policy applies to all customers of WebFoundry and to all visitors of the WebFoundry websites, including webfoundry.be and my.webfoundry.be.
The processing of personal data is carried out in accordance with:
- the General Data Protection Regulation (EU) 2016/679 of 27 April 2016 (GDPR);
- the Belgian Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data;
- the Act of 13 June 2005 on electronic communications.
Article 3: Controller and processor
For the personal data of its own customers and website visitors, WebFoundry acts as controller: WebFoundry determines the purpose and means of the processing.
"Personal data" means: any information relating to an identified or identifiable natural person.
When the Customer itself processes personal data of end users through WebFoundry's services (such as hosting, e-mail or databases), the Customer acts as controller and WebFoundry as processor. In that case, the Customer is responsible for obtaining the necessary consents from its end users and may conclude a data processing agreement with WebFoundry.
Article 4: Which data do we collect?
Depending on the service, WebFoundry may process the following categories of personal data:
- Identification data: name, first name, company name, VAT number;
- Contact details: address, e-mail address, telephone number;
- Financial data: invoicing data, payment details;
- Account data: username, customer number, order history, support tickets;
- Technical data: IP address, browser type, log files, data about the use of the website and services;
- Domain data: registrant data required for domain registration (e.g. with DNS Belgium).
Article 5: Purposes and legal bases
WebFoundry processes personal data exclusively on the basis of one of the following legal grounds: your consent, the performance of a contract, a legal obligation, or the legitimate interest of WebFoundry.
The specific purposes are:
- handling requests, quotations and orders;
- delivering, managing and invoicing the ordered services (hosting, domain names, e-mail, web design, e-commerce, SEO);
- providing customer support;
- sending service and marketing communications about our own products and services (with the option to unsubscribe);
- monitoring and improving the performance and security of the services;
- complying with legal obligations (including tax and accounting obligations);
- preparing internal analyses and statistics.
Article 6: Security
WebFoundry takes appropriate technical and organisational measures to protect personal data against loss, misuse and unauthorised access. These measures include: password protection and access control, encryption (SSL/TLS), firewalls, antivirus and intrusion detection systems, daily backups and staff awareness.
In the event of a data breach posing a risk to your rights and freedoms, WebFoundry will notify the competent supervisory authority and, where legally required, the data subjects.
Article 7: Disclosure of data to third parties
WebFoundry does not sell personal data to third parties. Personal data may, however, be shared with:
- service providers and suppliers necessary for the performance of the agreement, such as registrars and registries for domain names (e.g. DNS Belgium, SIDN, ICANN), SSL certificate issuers, data centres and payment providers;
- legal successors or affiliated companies, in the event of a transfer of activities;
- competent governmental and judicial authorities, where WebFoundry is legally obliged to do so;
- other third parties, exclusively with your prior consent.
When personal data is transferred outside the European Economic Area, WebFoundry ensures that an adequate level of protection is guaranteed in accordance with the GDPR.
Article 8: Your rights as a data subject
You have the following rights with regard to your personal data:
- Right of access: request a free copy of the personal data we process about you;
- Right to rectification: have inaccurate or incomplete data corrected;
- Right to erasure ("right to be forgotten"): have your data deleted when there is no longer a legal basis for the processing;
- Right to restriction of processing;
- Right to object: to processing based on legitimate interest, and at any time to direct marketing;
- Right to data portability: receive your data in a structured, commonly used and machine-readable format;
- Right to withdraw consent, without affecting the lawfulness of prior processing.
To exercise these rights, send a request with proof of identity to info (at) webfoundry (dot) be. WebFoundry will respond no later than one month after receipt of the request.
Article 9: Retention periods
WebFoundry does not store personal data longer than necessary for the purposes for which it was collected. Some indicative periods:
- Invoicing and accounting data: 7 years, in accordance with tax legislation;
- Customer and contract data: up to a maximum of 10 years after termination of the agreement, for legal evidence purposes;
- Technical log data: limited in time, for security and troubleshooting purposes;
- Marketing data: until you unsubscribe or object.
Article 10: Cookies and website
The WebFoundry website uses cookies and similar technologies whereby information is stored on and/or read from your device. Functional cookies (such as your language preference) are necessary for the proper functioning of the website. Analytical or marketing cookies are only placed with your consent.
You can always delete or block cookies via your browser settings. The information on the website is of a general nature and purely informative; access to the customer portal requires a username and password.
